NMC No New Water Connection 2014 Without Occupancy Certificate
NOW it is mandatory to obtain occupancy certificate for buildings to get drainage, water, and sewerage connections from Nagpur Municipal Corporation (NMC). Municipal Commissioner while issuing directions about necessity of occupancy certificates, has warned officers not to give any connection without occupancy certificate else they will have to face action.
Occupancy Certificate is compulsory for any building constructed in the city as per Development Control Rules (DCR). However, it seems that very few buildings got the certificates from Town Planning Department and rest of die buildings did not have the same. The developers are not obtaining certificate because they are violating sanctioned building plans without obtaining necessary permission from the competent authority. The Supreme Court, in an appeal, also held the necessity of Occupancy Certificate-Such construction may constitute danger to public safety, hygiene, and sanitation.
Hence, to avoid any hardship during demolition at a later stage, it is necessary to keep a check on development or construction at plinth level itself. Municipal Commissioner stated that the procedure during construction is required to be followed as per Clause number 7 of DCR of Nagpur.
DCR provides for issuance of pan Occupancy Certificate on the request of builder. Municipal Commissioner may issue pan Occupancy Certificate for a building or part thereof before completion of entire work, as per development permission. The said certificate could be issued, provided sufficient precautionary measures are taken by the holders to ensure public safety and health. According to Wardhane. it is necessary to ensure that no building is occupied without Occupation Certificate from NMC.
Municipal Commissioner has delegated powers to Assistant Commissioners in-charge Of respective zones to look after construction work going on as per sanctioned building plan and DCR. He has also directed that no drainage, sewerage connection should be provided by Health Officer or zonal offices in absence of Occupancy Certificate. Health Officer should direct all his subordinate officers to take cognizance of these directions and ensure strict compliance. Commis. has warned all officers not to provide connections without Occupancy Certificate. Otherwise, it will be treated as dereliction of duty on pan of the officers concerned and appropriate action will he initiated against them.
