MIHAN SEZ Power Crisis MADC Notice 2014
THE power supply crisis in Multimodal International Hub and Airport at Nagpur (MIHAN) and Special Economic Zone (SEZ) area. has attracted legal notice for the project promoter Maharashtra Airport Development Company (MADC). On Saturday, a legal notice was sent to MADC Chairman and other authorities of the company as well as Abhijcet MADC Nagpur Energy Private Limited (AMNEPL).Ajay Shyamsunder Soni. Vice-President of MIHAN Industries Association, served the legal notice to MADC. Chief Minister and Chairman of MADC Prilhviraj Chavan. Vice- Chairman and Managing Director of MADC Tanaji Satrc, Chief Engineer of MIHAN-SEZ S V Chahande. M/s AMNEPL through its Chairman. AMNEPL Directors Manoj Jaiswal. Abhishck Jaiswal. and A K Shrivastava. Soni served the notices through his counsel Adv Tushar Mandlekar.
In the notice, it was stated that M \i)C was dun hound lo eOSUR 'uninterrupted power supply to industries in MIHAN-SEZ area as it enjoyed the status of 'distribution licensee' under Section 14 of Electricity Act. 2003. Besides. MADC was dut hound to keep its promise of providing power to industries in MIHAN-SEZ area at the rate of Rs 2.97 per unit, vide a concession agreement il signed with AMNE-PL on November 7. 2007 for development and operation of coal-based power generation plant of 250 MW. AMNEPL is a Special Purpose Vehicle for generating power in MIHAN-SEZ area, and has 26 per cent equity of MADC.
However, instead of supplying electricity to consumers at promised cheaper rate, the notices were depriving the consumers of power supply. As against MERC order, the power supply to industries in MIHAN-SEZ area was disconnected arbitrarily' and this amounted to 'contempt', stated the notice. Further, the noticees were advising the consumers in MIHAN-SEZ area to approach Maharashtra Stale Electricity Distribution Company Limited (MSEDCLl and buy power at Rs 10 per unit. The actions of the notices amounted to 'willful breach' of orders passed by MERC on May 6. 2014 on the directions of Bombay High Court in writ petitions --" 1965/2014 and 2035/2014. By not supplying power to consumers, who have not opted for supply from MSF.DC1.. in MIHAN-SEZ area even till date the notices committed "contempt of court' and violated the directions of MERC, states the notice. Through the notice. Soni has demanded to provide immediately efficient and effective supply of power to members of MIHAN Industries Association as they were getting before the supply was disconnected arbitrarily on April 16. within 48 hours of receipt of the notice. Besides. Soni demanded immediate appointment of Grievance Redressal Forum. Committee, and Ombudsman as per Section 42 (5) (6) (7) of Electricity Act.
